PUBLIC HEARING SCHEDULED REGARDING CONVEYANCE OF GUNSCH PROPERTY

NOTICE OF PUBLIC HEARING

ON PROPOSED CONVEYANCE OF REAL PROPERTY

OF THE TOWN OF NEWBURGH

CONSOLIDATED WATER DISTRICT

 

 

            PLEASE TAKE NOTICE that pursuant to Section 198 of the New York State Town Law, a public hearing will be held on the proposed conveyance of real property of the Town of Newburgh Consolidated Water District not required for district purposes before the Town Board of the Town of Newburgh at the Town Hall, 1496 Route 300 in the Town of Newburgh, New York at 7:00 o'clock p.m. on January 22, 2018 at which time all interested parties will be heard.  A portion of the property located at 1792 Route 300, Newburgh, New York and shown on the tax map for the Town of Newburgh as Section 14, Block 1 Lot 145.2 is the subject of the following proposed conveyance upon which the public hearing will be held:

 

the proposed sale in fee of an approximately 2.00 acre portion of said property, which includes a house and driveway by bargain and sale deed for market value, subject to the following:

 

  1. The minimum sale price will be not less than $23,000;
  2. The property will be sold “as is.”  The Town is aware that the existing house contains  materials which require regulated  removal and disposal;
  3. The deed will include a restriction confining future use of the property to a single family residence and accessory uses;
  4. The property is subject to an existing right of way to a neighboring property;
  5. The property will be subject to conservation easement on approximately 0.75 acres adjacent to other Town Consolidated Water District property which restricts future use and development of the subject area to protect, enhance, preserve and protect said area;
  6. The purchaser will be required by contract at its expense to apply for and obtain building and any other required permit(s) for either the renovation of the house or its demolition and the construction of a replacement house prior to closing, and to commence and diligently prosecute the permitted work to conclusion within one year following the date of closing
