So 12 the Town Board conducted interviews of thirteen 13 applicants for the position of councilman in the 14 Town of Newburgh. 15 Somebody has a lot of background noise. 16 I don't know if somebody has to be muted, Bobby. 17 Can you hear the background? 18 Okay. It was a difficult choice, but 19 after all considered the Board went with Anthony 20 LoBiondo. Anthony is a lifelong resident of the 21 Town of Newburgh. He is married to Julianna, his 22 wife, for over 22 years. His son Christian is a 23 cadet second class in the United States Air Force 24 Academy. Their other son Michael is a high school 25 sophomore. The LoBiondo family provides annual 1 5 2 scholarships to graduating seniors at Newburgh 3 Free Academy. Anthony is a former member of the 4 board of directors of Children's Rights Society. 5 He's a former member of the board of directors of 6 Newburgh Rowing Club. Anthony obtained a bachelor 7 of arts degree from Binghamton University and 8 majored in law and society. He received a juris 9 doctorate degree from Albany Law School in 1991. 10 Anthony has been admitted to the New York State 11 Bar since 1992. He was admitted to Federal Court, 12 Southern District of New York, since 1997. He's a 13 member of the Orange County Bar Association. He's 14 a past president of the Middletown Bar 15 Association. From 1991 to 1997 he was assistant 16 district attorney for the Orange County District 17 Attorney's office. He's been in private practice 18 since 1997 until present. I am proud to say I 19 know him and the Town Board has made an 20 outstanding choice. 21 So at this point I'm asking for a 22 motion to appoint Anthony LoBiondo councilman for 23 the Town of Newburgh with a starting date of 24 today, July 13, 2020, with an annual salary of 25 $19,328.93. This appointment is to the office 1 6 2 left vacant by the resignation of James Presutti. 3 In accordance with New York State law, the 4 position will be on the ballot during this 5 November election. This appointment will run 6 through November 31, 2020 unless there are 7 extraordinary circumstances. 8 So with that, I'm going to take a 9 moment here to go down the hall and do a swearing 10 in. I want to ask whatever Council people and the 11 Town Clerk here to be present in that room. 12 Again, we'll exercise distance and masks and most 13 of it. I sincerely thank 17 the Members of the Board for their trust and 18 confidence in me. 19 As the Supervisor has stated, I'm a 20 lifelong resident of the Town of Newburgh. My 21 wife Julianna and I have been married for 22 22 years and we have raised my two boys, Christian 23 and Michael, here in this community that we love. 24 I can not be more proud to represent 25 this growing and resilient community. Town 1 9 2 government is the direct link connection to our 3 citizens. It shapes, it protects and it enhances 4 our community. Our Town has been very fortunate 5 to enjoy effective, and responsive, and efficient 6 town government. I promise that I will devote 7 myself wholeheartedly to give careful 8 consideration to all matters that come before the 9 Board and to continue the tradition that has made 10 us Newburgh. He's agreed to stay 3 on on a part-time basis, like a few hours a week, 4 but as a transition we've done interviews with 5 two engineering firms, and we actually came up 6 with one that we felt would be a good fit for us. 7 That was McGoey, Hauser & Edsall. 8 So I'm looking for someone to make a 9 motion that we go with McGoey, Hauser & Edsall. 10 Their contract is going to be subject to our 11 attorney's review. Cathy Drobne has reviewed it. 13 The school district has agreed with it, Marlboro 14 School District. 15 So based on that, I'd like someone to 16 make a motion to agree to this settlement which 17 is actually in the courts right now. 18 MR. On 12 this one, we done this last year. Orange County 13 actually has a program where certain families can 14 apply where there's certain income, it's kind of 15 on the low side. They can apply and their sons or 16 daughters, the county will actually pay them and 17 then assign them somewhere like as interns. It's 18 paid by the county. Last year we had a young 19 fellow who worked out very well. He happened to 20 work with my son Robert. Robert is the reservoir 21 caretaker at Chadwick. It worked out very well. 22 We're going with the program again. Hopefully 23 we'll get someone just as good, if not the same 24 person. They need a constant mentor. Someone has 25 to be with them all the time because some of them 1 19 2 are young. I just want to mention I was asked 9 electronically here if the Ethics Board is paid. 10 The Ethics Board members are not paid. It's 11 totally volunteer actually. Any Ethics Board 12 member appointed has to be appointed by the 13 entire Board. So it's got to be 5-0 in order to 14 appoint an Ethics person to the Ethics Board. 15 They meet once a year unless they're called upon 16 for additional meetings. So that's that. 17 Other than the announcements, again I 18 want to thank everyone that's here and came to 19 the meeting. 20 I want to congratulate Anthony 21 LoBiondo. 22 I think New York seems to be doing 23 pretty good as far as the number of people 24 deceased, which is excellent. Other parts of this 25 country are not doing so well. So again, we could 1 21 2 just hope and, those of us who pray, pray that 3 things will definitely get better and we'll all 4 be together some day in a real room and be able 5 to talk. 6 Next I'll go to Betty. Betty, do you 7 have any announcements for us? 8 MS. GREENE: The only thing is wear 9 your masks, stay healthy, and as Gil Piaquadio 10 said, maybe we can all be together in the same 11 room. RUGGIERO: I just want to 15 congratulate Anthony, and thank you to all the 16 other applicants for coming out and giving it a 17 try. First, congratulations Anthony. It was 24 very hard with thirteen people. I had brought up 25 to a couple of the interviewees that I was also 1 22 2 appointed but not the first time. I had to go 3 back for a second time. I did not get it the 4 first time. So please everybody, keep that hope 5 alive. 6 Also I want to thank our Recreation 7 Department. If you take a look on their web 8 page, there are several programs they are 9 starting this summer. They're getting back. We 10 have the outdoor gym, the playground open. 11 There's no junior police academy but we do have a 12 leadership academy which is kind of an 13 abbreviated type of police thing. So please take 14 a look at that. And I think that's about it. 15 Gil, I don't know if you can hear me 16 but on that electronic thing, it asked about the 17 Ethics committee, it's also asking about that 18 certiorari settlement. 19 SUPERVISOR PIAQUADIO: We'll talk about 20 that in a second. Absolutely. 21 Mark, if you're there, do you want to 22 just give us a little bit on the Orchard Hills 23 settlement that we're dealing with? 24 MR. TAYLOR: Orchard Hills is a large 25 apartment complex off of 9W, towards the northern 1 23 2 end of the Town, near Cedar Hill Cemetery. Its 3 appealed it's assessment for the years 2017, `18, 4 `19, and actually this year as well. This year it 5 hasn't gotten to the stage where it's gone to 6 court yet. It's still before the Board of 7 Assessment Review. 8 The settlement provides for reductions 9 from -- for each of those years in question. It 10 was originally assessed at approximately 11 $13,000,000, which unfortunately I don't have it 12 in front of me but it's an approximate market 13 value of 50,000,000. And the reductions were 14 approximately 1,000,000 each year. In 2019 the 15 assessment was actually reduced, but it's still a 16 reduction of approximately the same amount. And 17 in 2020 the assessment will be reduced to a 18 $9,000,000 figure. That assessment will be -- 19 remain in place for three years, absent any major 20 changes in condition, or Town-wide reevaluation, 21 or certain other triggers under State statutes. 22 The Town's liability will be just north 23 of $100,000 for the three years we'll have to 24 repay the assessment. That includes both town 25 and highway but not water district. The school 1 24 2 district will have a refund liability well in 3 excess of $500,000, and they are given, I believe 4 it's the three-year period to repay the larger 5 amount under the terms of the settlement. 6 SUPERVISOR PIAQUADIO: Thank you, Mark. 7 And Joseph, if the viewers go to 8 additional items under the agenda, they should be 9 able to actually see that settlement as it's 10 described. Is that true, Joe? 11 MR. PEDI: Yes. I'll check but I 12 thought I put it online. But I'll check after 13 this meeting. TAYLOR: I believe the submissions 7 of interest are likely subject to FOIL. 8 Accordingly, you could disclose them. Thank you for asking. 15 I did have just a couple of things I 16 just wanted to mention. Once again, I'm going to 17 be doing Narcan training for the Town of 18 Montgomery tomorrow if anybody is interested. You 19 can register online with Sergeant Detective 20 Farina and he'll get you the link and you can get 21 Narcan trained and get a Narcan kit. 22 I also just want to say a special thank 23 you to Scott. I reached out to him because I'm -- 24 in my paid job I'm a clinical manager at a home 25 care agency right in Newburgh. We were having a 1 30 2 surgical mask shortage. There's a national 3 shortage of them again. Scott linked me up with 4 someone -- two people. One person -- I'm not 5 going to say the names because I'm not trying to 6 throw anybody under the bus. One person was going 7 to charge us a goodly amount for the masks, but I 8 was willing to pay for them because we were 9 desperate. And then I, just for kicks, called 10 the other person, and that gentleman is, in my 11 mind, a hero because he is just charging us what 12 he paid for them. We're a very small non-profit 13 home care agency so we -- these exorbitant prices 14 that we've been paying for equipment is throwing 15 us, you know, practically to bankruptcy. So I was 16 so grateful to this gentleman. We're buying like 17 2,000 masks from him for our nurses and 18 clinicians. We go through about 250 masks every 19 day. I just really wanted to say thank you to 20 Scott for that connection because I would have 21 been price gouged had it not been for you. So 22 thank you. 23 MR. MANLEY: You're welcome. Glad it 24 worked out. 25 MS. MANDEL: It was super helpful. 1 31 2 Gosh, what was the other thing I wanted 3 to mention? Oh, yes. I just again wanted to 4 just question again about the police policies in 5 Newburgh and is there going to be a public quorum 6 about our practices in terms of hiring a diverse 7 workforce and our practices around dealing with 8 the public in terms of sensitivity and mental 9 health, because it's such a prominent issue in 10 our community? In our State of course but also 11 in Orange County, specifically Newburgh, because 12 we don't have an acute psychiatric hospital in 13 Newburgh. We were getting more use out of 14 Cornwall but we don't. Haven't for a long time. I 15 was just wondering what the plan was for that 16 regarding the police. Thank 19 you for what you do as well. 20 I think the Governor has mandated every 21 police department has one year to put a plan in 22 place to look at their policies and how they deal 23 with the community. This is all yet to come. All 24 too often many municipalities have to hire off 25 the Civil Service list, so sometimes it isn't a 1 32 2 fact of what color or religion or whatever you 3 are but whoever is the top three on that list who 4 took the test. So until they modify that or 5 change it, you just have to go by who is the top 6 three on that list when you hire. So with that, 7 we'll see. The plan is supposed to change. They 8 have one year to change it over the next year. We 9 always seems -- we are very fortunate with our 10 police and the number of incidents that we have. 11 I really take my hat off to them because I think 12 they do a great job. 13 With that, I don't think I have 14 anything else to say. 15 There's no one else, Bobby? 16 MR.
