WARD-WILLIS: This is Nick Ward- 11 Willis with Keane & Beane for Gas Land. We're 12 appearing before you tonight to request a zone 13 change with respect to property located at 42 14 South Plank Road, located at the corner of South 15 Plank Road and Fifth Avenue. It's been a gas 16 station for decades and our client wishes to make 17 some improvements to it. We recognize it's a 18 little tired. And in addition to some 19 landscaping, the building itself could be -- have 20 a new facade on it that would make it consistent 21 with the neighborhood, try to give it more of a 22 residential feel. 23 We submitted an application to the 24 Planning Board. We had a good conversation and 25 feedback with them. We thought that even though TOWN WORKSHOP MEETING - 7/27/20 1 8 2 we're a pre-existing nonconforming use, we're a 3 gas station in a residential zone, we felt that 4 we fit one of the exceptions because we weren't, 5 in our mind, doing an expansion as it's defined 6 in the code. The Town staff and Planning Board 7 did not agree. They recommended that we should 8 apply for a use variance. I'm a municipal 9 attorney, I can't imagine you'll apply the use 10 variance criteria any differently in Newburgh 11 than where I am in Beacon, or in New Castle, or 12 any other municipality. We recognize that's an 13 uphill battle and not a realistic one. We don't 14 want to miss this opportunity to improve that 15 property, address some of the concerns regarding 16 parking, the dumpster, some landscaping, the 17 fence, but more importantly the building. We 18 don't have any intention of increasing the number 19 of pumps, the canopy. We really just want to 20 refurbish a tired site. 21 So what we'd like to do is have that 22 property rezoned to the B District. If we can put 23 some of the PDFs I provided to the Town up on the 24 screen, if someone can share that with you, 25 you'll see where our property is in relation to TOWN WORKSHOP MEETING - 7/27/20 1 9 2 other commercial uses in the area. 3 Do you know the property? We're a 4 stone's throw from Route 84. We're -- on Route 52 5 there's a commercial property, a former dentist's 6 office behind us, a chiropractor to the side, and 7 of course the other commercial uses when you come 8 up the highway. 9 I don't know if the Board Members had 10 an opportunity to review the land use map that 11 was shared with you. I don't know if that's able 12 to be put up on the screen. If it can be, I would 13 appreciate it. If not, you can refer to it and 14 you'll see that it's not -- it's consistent, in 15 our minds, with the use of the site. Even though 16 it's zoned residential, in all fairness I don't 17 see that property ever being purchased and 18 converted into a residential structure. It's 19 going to remain a gas station. It has been for a 20 number of decades. It's, in my mind, consistent 21 to move it into the Business Zone. It's a good, 22 logical extension of that zone. Because we can't 23 get site plan approval without it, we need to -- 24 we'd like to get that district changed. 25 So what we have also before you was a TOWN WORKSHOP MEETING - 7/27/20 1 10 2 zoning compliance table that we provided to the 3 Town that shows that we meet, for the most part, 4 all of the existing dimensional requirements. 5 There are some where we would be at pre-existing 6 nonconforming use. 7 The important one for rear and the side 8 yard, for example distance between the property 9 behind us, we meet that. In fact, it requires 30 10 feet. We're providing 55. The last document that 11 we provided -- and I can go through those 12 setbacks in more detail if you'd like. We do 13 think we meet most of them. And for some that we 14 don't, it would be a pre-existing nonconforming 15 use, but it's not, in my mind, one of the more 16 material ones, like the side yard setbacks, the 17 lot width, the lot area. It's distance from -- 18 separation to a parked car is one example. 19 If you look at the last slide, the last 20 PDF that we provided to the Town, it sort of 21 shows you a concept plan, what we envision. All 22 we're envisioning is adding some parking spaces 23 to meet where -- to sort of make the flow of the 24 traffic go through easier, add some landscaping 25 on the Fifth Avenue side, add a defined entrance TOWN WORKSHOP MEETING - 7/27/20 1 11 2 -- ingress and egress. Right now it's an open 3 curb along the entire side of Fifth Avenue. We 4 think that can be improved. We're showing some 5 improved landscaping at the back of the site by 6 the dumpster, recognizing that could be improved 7 as well. And the significant improvement is 8 adding 750 square feet of space at the rear of 9 the property. One of the main reasons for doing 10 this is that it allows us to internalize our 11 restrooms. Right now the restrooms are accessed 12 from the outside, posing a problem, in my mind, 13 for the community but also for us. We don't have 14 the ability to police it as well as if we had 15 restrooms that could only be accessed by entering 16 the store where we could control it and monitor 17 the activity. Obviously, as you could imagine, 18 see if people are up to no good or make sure 19 they're in and out of there as appropriate. So 20 the addition allows us to do that. It also gives 21 us some increased storage space with respect to 22 coolers to meet current demands of the market. If 23 we do that 750 square foot addition, we're still 24 meeting the rear yard setback to our neighbor in 25 the rear, because it's currently 50 and I believe TOWN WORKSHOP MEETING - 7/27/20 1 12 2 it would be approximately 30 or so. 3 So we think that this is a good 4 solution to meet our needs, and also what I 5 suspect, ones for the Town and the community, is 6 to refresh that site a little bit. 7 So that's it in a nutshell. I can 8 provide you with more details. That's what we're 9 before your Board tonight. If you have any 10 questions or comments, we'll answer them. 11 The next step is if you're favorably 12 inclined, or at least would like to entertain it, 13 and I know you have to go through a public 14 hearing process, we would submit a petition 15 requesting a zone change, that our property be 16 rezoned to the B District. 17 I apologize. TAYLOR: As well as to cover the 15 Town's costs with respect to the process. 16 If the Board is favorably inclined, we 17 could actually go ahead and start preparing the 18 local law upon receipt of the petition and not 19 await your authorization at the next meeting. 20 MR. MANLEY: Either way, it affords a 21 final for the zoning change. We would still have 22 to have a public hearing. 23 MR. TAYLOR: That's correct. The matter 24 will have to be referred to the Orange County 25 Planning Department, the Planning Board, the ZBA. TOWN WORKSHOP MEETING - 7/27/20 1 14 2 The Town Board will have to schedule a public 3 hearing. The Board, typically with map changes, 4 notifies every property owner within 500 feet of 5 the affected property of the proposed change and 6 of the hearing, and that requires, you know, some 7 time to accomplish. You typically have the 8 assessor prepare that list of property owners, 9 the applicant prepares the envelopes, and then 10 the Town staff actually mails the notices out. 11 MR. MANLEY: Okay. It's just easier 12 because we're on a Zoom meeting, I'll just go 13 through each Board Member. 14 Betty, do you have any questions or 15 comments? 16 MS. GREENE: No. I'm fine. 17 MR. They're raising -- increasing their 22 rate from $60 an hour to $65 an hour, but it's 23 still cheaper than what we paid three years ago, 24 $82.50 an hour. 25 So I'm looking for a motion to renew TOWN WORKSHOP MEETING - 7/27/20 1 18 2 the service agreement starting August 1st. The company we've been using is 12 Synovia Solutions. We did put this out to bid 13 with three different companies. We were paying 14 approximately $1,400 a month from Synovia. Their 15 new bid is down to $1,000 a month, 12,000 a year. 16 The second closest would be 14,000. The next one 17 is 17,000. 18 So I'm looking for a motion to accept 19 the lowest cost, which is a company we've already 20 been using. We're going to have more vehicles 21 with GPS and we're going to replace all the GPSs 22 in every vehicle to more upgraded ones. Is that all 13 items that are in the current contract we have? 14 MR. MANLEY: I know most of that is. 15 Our vehicles are assigned to the people and 16 that's how we correlate it. 17 MS. GREENE: I thought -- say somebody 18 is on vacation and a different driver gets behind 19 the wheel, as to how that is going to keep track. 20 MR. RUGGIERO: There's no way you can 21 track an actual person driving that vehicle to 22 who it is. It's done by the vehicle and the 23 assignment of the vehicle, no matter any GPS 24 system.
