HEARING SCHEDULED FOR ZONING CHANGE

TOWN OF NEWBURGH

NOTICE OF PUBLIC HEARING

ON PROPOSED LOCAL LAW

                                   

            PLEASE TAKE NOTICE that there has been introduced before the Town Board of the Town of Newburgh in the County of Orange and State of New York on June 25, 2018, Introductory Local Law No. 9 of the Year 2018 entitled “A Local Law Amending Chapter 185 entitled ‘Zoning’ of the Code of the Town of Newburgh and the Zoning Map of the Town of Newburgh to Extend the Professional Office Overlay (O) District to Include An Adjacent Parcel on the West Side of Balmville Road:  Section 84  Block 5 Lot 26.”

 

The purpose and effect of the local law is to extend the Professional Office Overly (O) District to include an approximately 8.60 acre parcel located at 11 Balmville Road, identified on the Orange County tax map for the Town of Newburgh as Section 84 Block 5 Lot 26.  The parcel is in the R-1 Residential Zoning District and is adjacent to current boundary of the O Overlay District.  In addition to the underlying residential (R-1) District’s permitted uses and uses subject to site plan review by the Planning Board, extending the O Overlay District will allow “offices for professional use” as a use of the parcel subject to site plan approval by the Planning Board.  The Zoning Code specifies yard and other bulk requirements and additionally sets forth certain restrictions on professional office uses in the O Overlay District.  The parcel contains a building which was previously used as a senior residential/nursing facility by the Goldsmith D. and Mary B. Johnes Home for Aged Couples but is currently vacant.  11 Balmville Road, LLC has applied for the property to be included in the O Overlay District.     

 

A link to the Municipal Code which includes the Zoning Chapter and the Tables of Use and Bulk requirements for the R-1 Zoning District and O Overlay District, showing the allowed uses in the Districts and the bulk requirements for each use can be found at the Town’s website, townofnewburgh.org.  The enactment of the proposed Local Law has been identified by the Town Board as an Unlisted Action under the regulations adopted pursuant to the State Environmental Quality Review Act.

    

            PLEASE TAKE FURTHER NOTICE that pursuant to Section Twenty of the Municipal Home Rule Law, a public hearing will be held on the aforesaid proposed Local Law before the Town Board of the Town of Newburgh at the Town Hall at 1496 Route 300 in the Town of Newburgh, New York at 7:00 o'clock p.m. on August 13, 2018 at which time all interested parties will be heard. 

            The Town of Newburgh provides reasonable accommodations for the disabled. Disabled individuals who need assistance in order to participate should contact the Town Clerk’s office at 564-4554.  Advance notice is requested.
